Commercial Dispute — Arbitration Clause Enforcement

CS(Comm) No. 234/2025
5 April 2025

Summary

Order on application under Section 8 of the Arbitration Act for reference to arbitration, examining the validity and scope of the arbitration clause.

Order Details

The defendant filed an application under Section 8 of the Arbitration and Conciliation Act, 1996, seeking reference of the dispute to arbitration based on the arbitration clause contained in the agreement between the parties.

The plaintiff opposed the application contending that the arbitration clause was vague and did not constitute a valid arbitration agreement, and further that the disputes arising from allegations of fraud could not be referred to arbitration.

The Court examined the arbitration clause in light of the Supreme Court's decisions on the interpretation of arbitration agreements and the scope of Section 8.

The Court held that the arbitration clause was sufficiently clear and that mere allegations of fraud do not ipso facto vitiate an arbitration agreement. The Court referred the parties to arbitration and stayed the proceedings.
